WHAT IS THE PARTY WALL ACT?
If you are planning to carry out any building work consideration should be given to this legislation. There is a legal obligation to serve notice where applicable and it is advisable to seek verification from an experienced surveyor before starting any kind of building work. We can advise on any matters associated with works in pursuance of the provisions of the Party Wall etc. Act 1996 as well as issues relating to scaffolding, crane oversailing and other neighbourly matters.
WHAT IS A RIGHT TO LIGHT?
An easement which may be acquired in several ways, the most common is a prescribed right by virtue of uninterrupted enjoyment for 20 years. A right to light is protected under common law, adverse possession and in England and Wales by the Prescription Act 1832. We can provide experienced advice on right to light issues as well as any problems relating to daylight, sunlight, overshadowing and associated issues in connection with any planning application.
